Jackson Insurance Bad Faith Claims
Litigating Against Bad Faith Insurers in Mississippi
Too often, insurance claims get denied, or benefits delay for so long that it amounts to a denial. If the insurance company has denied or delayed your claim, you may have the right to file a claim for bad faith. Under the law, insurance companies are legally obligated to grant you full benefits per your policy or provide adequate reasoning (in writing) why your claim is denied. In either case, they're legally obligated to investigate your claim as quickly as possible.
Funderburg, Sessums & Peterson, PLLC has prosecuted claims against insurance companies that have wrongfully delayed or denied death benefits, private disability benefits, benefits under ERISA plans, workers’ compensation benefits, fire loss claims, property damage claims, uninsured motorist benefits, and personal injury claims. We have pursued actions for compensatory and punitive damages in Mississippi state and federal courts, and we have successfully represented clients whose claims were wrongfully denied.
Signs of Insurance Bad Faith
Some of the red flags you should watch out for are obvious: if your insurer is offering you far less than you need to recover, refuses to offer the benefits promised in your policy, or refuses to investigate your claim within a few weeks, then you might be facing a wrongful delay of your case. However, there are less obvious signs as well—such as when an insurer puts new agents on your claim on a frequent basis, requires you to file the same paperwork over and over again, or requires new or different evidence every few weeks.
We pursue damages against:
-
Insurance companies
-
Agents
-
Third party administrators
